markit by Reserv Inc. – Terms and Conditions

1. Acceptance of Terms

By downloading, installing, accessing, or using markit (“the App”) provided by Reserv Inc., a Wyoming corporation (“Reserv,” “we,” “our,” or “us”), you agree to these Terms and Conditions (“Terms”).
If you do not agree, do not use the App.

2. Who Can Use markit

  • You must be at least 13 years old to create an account or use markit.
  • If you are between 13 and 18, you must have permission from your parent or legal guardian to use mark.it.
  • mark.it is currently intended for users located in the United States.
  • You are responsible for keeping your account information and password secure.

Parental/Guardian Concerns

If you are a parent or guardian and believe your child has created an account without your consent, please contact us at info@heyitsmarkit.com so we can review and, if necessary, delete the account and associated information.

3. What markit Does

markit lets you:

  • Send and redeem e-gift cards.
  • Participate in promotions, giveaways, and “pay it forward” activities.
  • Receive location-based offers and notifications when near participating businesses.

4. Payments and E-Gift Cards

  • Payments are processed securely through Stripe. We do not store your full payment card details. See Stripe’s privacy policy: https://stripe.com/privacy.
  • E-gift cards are issued through Tillo. See their privacy policy: https://www.tillo.com/privacy-policy.
  • E-gift cards and promotions may be subject to additional terms (e.g., expiration dates or usage limits) as displayed in the App.

5. Your Responsibilities

When using markit, you agree:

  • To provide accurate and up-to-date information.
  • Not to use the App for fraudulent or unlawful purposes.
  • Not to interfere with the operation of markit (e.g., hacking, reverse-engineering, or automated data scraping).
  • To respect all applicable laws and the terms of any third-party services linked through markit.

6. Location-Based Features

markit uses your device’s location to verify your eligibility for certain offers and redemptions. You can disable location access in your device settings, but some features may not work.

7. Communications

By creating an account, you agree to receive essential communications (like account confirmations and security alerts).
You may also receive limited product announcements (like app launch updates). You can opt out of non-essential communications anytime.

8. Intellectual Property

All content and materials in markit—including text, logos, designs, and software—are owned by Reserv Inc. or licensed to us. You may not copy, modify, distribute, or create derivative works without our written consent.

9. Disclaimers & Limitation of Liability

  • markit is provided “as is” and “as available” without any warranties, express or implied.
  • We are not responsible for:
    • Any errors, downtime, or interruptions of service.
    • The accuracy or reliability of gift card balances issued by third parties.
    • Any losses from unauthorized use of your account.
  • To the maximum extent allowed by law, our liability is limited to the greater of $50 or the amount you paid us in the past 6 months.

10. Termination

We may suspend or terminate your account if we believe you violated these Terms or used the App in an unlawful or harmful way. You may delete your account at any time.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of laws principles.
Any disputes will be resolved in state or federal courts located in Wyoming, unless prohibited by law.

12. Changes to These Terms

We may update these Terms at any time. If we make significant changes, we will notify you through the App or by email. Continued use of the App after changes means you accept the new Terms.
